Effective 4 November 2026
Submission Terms
The contract for anything you send through a Casitel tool: what we keep, what we promise and what we do not.
Version 1.0. Effective 4 November 2026.
Please read this first. These Terms are a contract between you and Casitel. They apply each time you send us something through a Casitel tool. The main points are below. The full Terms follow, and the full Terms control.
- We keep what you send. You give us a lasting licence to keep and use project, asset, pricing and market information (clause 6). If you are a Consumer, we keep it only in de-identified form after your request ends (clause 6.6).
- Personal data is different. Your data protection rights stay with you. These Terms do not remove them (clauses 17 and 18).
- We protect what you send. We keep your contact details apart, and we do not name you or your project without your permission (clause 7).
- Send only what you may share. Do not send documents under an NDA without permission (clause 8).
- We promise no reply. We may decline any request and we do not have to give a reason (clause 11).
- We give no advice. Nothing we send is a valuation, an offer, or legal, financial or investment advice (clause 10).
- Our liability is limited as far as the law allows, and more narrowly for businesses than for Consumers (clause 15).
1. Definitions
1.1 In these Terms:
- Affiliate means a company that controls, is controlled by, or is under common control with a party.
- Business Submitter means anyone who is not a Consumer. It includes a company, a fund, a partnership, a sole trader, and an individual who acts for any of them.
- Casitel, we, us and our mean Lewga FZC LLC, trading as Casitel, formation number 4426932, registered office Business Centre, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.
- Consumer means an individual who acts for purposes wholly or mainly outside their trade, business, craft or profession. We treat you as a Consumer if you tell us that you act as a private individual, unless the facts show otherwise.
- Contact Data means your name, email, phone, role, preferred way to be reached, and any other detail that identifies you as a person.
- De-identified Data means information that we have changed or combined so that it does not identify you, your company, your project or any other person, and so that no one can reasonably link it back. A precise boundary, a title number or an exact address is not De-identified Data.
- Derived Data means anything we create from a Submission or other sources. It includes analysis, scores, classifications, benchmarks, models, indices, statistics and Reports.
- Permission means your express agreement in writing. An email is enough.
- Personal Data means information about an identified or identifiable individual, or any similar term in the data protection law that applies.
- Privacy Notice means the notice at casitel.com/privacy.
- Project Information means information in a Submission about land, sites, assets, projects, power, grid position, planning, capacity, costs, prices, terms, capital mandates, compute needs, bills, markets and transactions. It does not include Contact Data.
- Report means any note, range, shortlist, benchmark or other output that we choose to send you.
- Service Provider means a company that processes information for us under a contract with duties of confidence. It includes hosting, storage, email, security and model providers.
- Submission means everything you send us through a Tool, by upload or by any follow-up message. It includes Project Information, Contact Data and Uploaded Files.
- Tool means any form, check, desk, tracker or similar feature on casitel.com or a related site.
- Uploaded File means a document, plan, parcel file, image, bill, quote, budget or other file in a Submission.
1.2 "Including" means "including without limitation". Headings do not affect meaning.
2. Acceptance
2.1 You accept these Terms when you tick the box at Submit and send your Submission. You cannot send a Submission without ticking the box. We do not tick it for you.
2.2 The version shown when you tick the box applies to that Submission. We record the version, the date and time, and the Tool you used.
2.3 If you do not accept these Terms, do not send a Submission. You may still use the public parts of our site under our Terms of Use.
2.4 These Terms sit alongside our Terms of Use. If the two conflict about a Submission, these Terms apply. A signed agreement between you and Casitel overrides these Terms where it says so.
2.5 You may save or print these Terms. We keep each version and provide a copy on request.
3. Eligibility and authority
3.1 You confirm that:
(a) you are at least 18 and able to enter into a contract;
(b) if you act for a company or another person, you have authority to bind them, and "you" then includes them;
(c) you may lawfully send your Submission and give the rights in these Terms;
(d) you are not, and you do not act for, a person who is subject to sanctions that apply to us or to you; and
(e) you will not use a Tool in breach of export control or sanctions law.
3.2 If you act as a broker, an agent or an adviser, you confirm that you hold a current mandate from your principal. We may ask you to name your principal and show the mandate.
3.3 We may ask you to confirm who you are, or your link to an asset. If we cannot confirm it, we may decline the Submission.
4. The Tools
4.1 The Tools collect information so that we can review a request. A person at Casitel may prepare a Report for a request that we choose to take forward.
4.2 There is no fee for a Tool. You do not owe us a fee, and we do not owe you one, unless a signed agreement says so.
4.3 We may change, pause or withdraw any Tool at any time.
4.4 In return for the rights you give us, we make the promises in clause 7. Those promises bind us whether or not we prepare a Report.
5. Your Submission
5.1 You confirm that your Submission is accurate and not misleading as far as you know. You will tell us if you find a material error.
5.2 Do not send:
(a) anything that you are not free to share (see clause 8);
(b) passports, national identity numbers, bank details or payment card details;
(c) health data, or data about race, religion, politics, sexual life or criminal records;
(d) data about children;
(e) export-controlled technical data, classified material or inside information about a listed company; or
(f) malware, or anything that you know to be unlawful.
5.3 If a document shows any of these details, remove or cover them before you upload it. Title deeds in some countries show identity numbers. Please cover them.
5.4 We may delete or quarantine anything that breaks this clause. We do not have to check Submissions for these items.
6. Licence
6.1 You keep ownership. You keep whatever rights you own in your Submission. This licence does not transfer ownership to us.
6.2 Licence. In return for our promises in clause 7, you grant Casitel a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to host, store, copy, analyse, adapt, translate, combine with other data, and make Derived Data from your Project Information and Uploaded Files.
6.3 Purposes. We may use that licence to review your request; to prepare Reports; to build, check, improve and operate Casitel's data, products, models and services; and to publish or supply De-identified Data and Derived Data that meets clause 7.3.
6.4 Sublicence and transfer. We may sublicense these rights to our Affiliates and Service Providers for these purposes. We may transfer them to a successor to all or part of our business, and the successor must keep to clause 7.
6.5 Personal Data is outside this licence. This licence does not give us any right over Personal Data beyond what data protection law allows. We handle Personal Data under clause 17 and the Privacy Notice. Nothing in this clause limits a right that data protection law gives you. Where Project Information is also Personal Data, that law applies to it for as long as it stays Personal Data.
6.6 Consumers. If you are a Consumer, we use your identifiable Project Information and Uploaded Files only to review your request, for the retention periods in the Privacy Notice, and as law allows. After that we delete them or turn them into De-identified Data. Clause 6.2 continues for De-identified Data only.
6.7 Duration. This licence continues after your request ends, after we decline it, and after we remove your Contact Data. It does not end because you ask us to stop reviewing your request. If we materially breach clause 7, you keep your remedies for that breach, but De-identified Data already made and Derived Data stay ours to keep and use.
6.8 Derived Data. As between you and us, Casitel owns Derived Data and De-identified Data, and all rights in our databases, models and methods. We do not owe you a fee or credit for them.
6.9 Third-party rights. Where someone else owns rights in an Uploaded File, this licence covers only what you are able to give. We use those files to review your request and to extract facts. We do not republish them.
6.10 Moral rights. To the extent the law allows, you agree not to assert moral rights in your Uploaded Files against uses that these Terms permit.
7. How we protect your Submission
7.1 Contact Data. We keep Contact Data apart from Project Information and limit access to the people who need it. We do not sell Contact Data. We do not give it to a counterparty without your Permission.
7.2 Naming. We do not publish your name, your company's name or your project's name, and we do not give them to a third party, without your Permission.
7.3 Publication. We publish or supply information from Submissions only as De-identified Data or Derived Data that does not reveal your identity or your project. We set minimum group sizes and other checks for this purpose.
7.4 Uploaded Files. We do not show your Uploaded Files to third parties, other than as clause 7.5 allows.
7.5 Permitted disclosure. We may disclose a Submission to:
(a) our staff, Affiliates, Service Providers and professional advisers who need it and who owe us duties of confidence;
(b) a court, a regulator or a public authority where law or a lawful order requires it, or where we need to bring or defend a legal claim;
(c) a buyer, investor or lender in our business, or a successor, under a duty of confidence; and
(d) anyone else with your Permission.
7.6 Limits. Clauses 7.1 to 7.4 do not apply to information that is public other than through our breach, that we already hold, that we receive lawfully from another source, or that we develop independently. We collect data from public and licensed sources. Those sources may overlap with your Submission. Your Submission does not limit our use of that data.
7.7 No other duty. These Terms are our only confidentiality duty for a Submission, unless we sign an NDA with you. A confidentiality label on a file does not change these Terms. We owe no fiduciary duty.
7.8 Security. We use reasonable technical and organisational measures to protect Submissions. No system is completely secure.
8. Third-party material
8.1 Do not send material that you hold under an NDA or another duty of confidence unless you have the right to share it with us on these Terms. This often applies to quotes, bills, contracts, grid offers, tender documents and investor materials.
8.2 If you are unsure, leave the document out. You may also remove the other party's name and any term that you must keep confidential. Several Tools let you do this.
8.3 Do not send anyone else's copyright work unless you may do so. Land registry extracts, title plans and map data can carry third-party rights.
8.4 Only include another person's Personal Data, such as a co-owner, a tenant or a counterparty contact, if you need to and you are allowed to share it. Where the law requires it, tell them that you have shared it and point them to our Privacy Notice.
8.5 If you think that a Submission contains your confidential or copyright material, write to hello@casitel.com. Give us enough detail to find it. We review each notice. We may restrict or remove the material while we do so.
9. Reports
9.1 Reports are for your own internal use. You may share a Report with your professional advisers if they accept that they may not rely on it.
9.2 Do not publish a Report, use it in marketing or an offering document, or say that Casitel approves or values anything.
9.3 We own Reports. We license you to use a Report for the purpose in clause 9.1 only.
9.4 No one other than you may rely on a Report, and you may rely on it only as clause 10 and clause 14 allow.
10. No advice and no regulated activity
10.1 Information only. The Tools and Reports give general market information. They are not tailored advice.
10.2 No valuation. A value range, benchmark or price comment is an indicative market view. It is not a valuation, an appraisal or a survey. It does not follow any valuation standard, including the RICS Red Book. A registered valuer has not prepared it, and you must not use it for lending, tax, accounts, or a purchase or sale decision without taking your own valuation.
10.3 No investment service. We do not give investment advice or recommendations. We do not offer or solicit any security, fund interest or other investment. We do not arrange deals, act as a broker or dealer, or manage assets. Anonymised opportunities or matches are general information and not an invitation to invest.
10.4 Capital Desk. Capital tools are for institutional and professional investors only. If you use them, you confirm that you are one under the rules that apply to you. They are not for retail investors.
10.5 No agency. We do not act as your agent, estate agent, broker, adviser or fiduciary. We do not take instructions to sell, buy, let or find any land or asset. Any such service needs a separate signed agreement and, where the law requires it, a licensed firm.
10.6 No other professional advice. Nothing we send is legal, tax, accounting, engineering, planning or grid connection advice. A date or a chance of power is an estimate. It is not a promise by us or by any network operator.
10.7 Indicative tools. A demand pool or a similar feature is indicative only. It is not a reservation, an order, an offer or a purchase commitment by anyone. It takes no money. Any deal needs a separate signed agreement.
10.8 Your decisions. Take your own professional advice before you act. Your decisions are yours.
11. No obligation to respond
11.1 We decide in our sole discretion whether to review a Submission, take it forward, prepare a Report, or stop at any point.
11.2 We may decline any request. We do not have to reply, give a reason, or meet any date. Any note that we send about a declined request is a courtesy. It does not create a duty to send another.
11.3 A Submission does not create a partnership, a joint venture, an agency, an exclusivity right, a right to a fee or commission, or a duty to introduce you to anyone.
11.4 We may work with others, including your competitors and counterparties. We may hold or develop interests in similar assets or opportunities, and we may already know similar information. None of this breaches these Terms if we keep to clause 7.
11.5 Clause 11 does not limit a duty that the law gives you, such as a duty to answer a data protection request.
12. Competition law
12.1 Do not use a Tool to agree prices, bids, capacity or markets with a competitor, or to learn a competitor's current or future prices.
12.2 We publish only aggregated information under clause 7.3. We may refuse or hold back information to protect competition.
13. Acceptable use
You must not misuse a Tool. You must not send false Submissions, pose as someone else, test our security without our written agreement, scrape a Tool, or use a Tool to build a competing dataset.
14. Disclaimers
14.1 We provide the Tools and Reports "as is" and "as available".
14.2 To the extent the law allows, we exclude all warranties and conditions that are not set out in these Terms. That includes any warranty of accuracy, completeness, timeliness, fitness for a purpose or a particular result.
14.3 Reports may use public, third-party, modelled and automated inputs. Those inputs may be wrong or out of date. A Report speaks only as of its date. We do not have to update it.
14.4 This clause does not exclude a right that the law says cannot be excluded.
15. Liability
15.1 What we do not limit. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that the law does not allow us to limit or exclude.
15.2 Business Submitters. If you are a Business Submitter, and subject to clause 15.1:
(a) we are not liable for any loss of profit, revenue, business, opportunity, contract, goodwill or anticipated saving, or for any loss of or damage to data, or for any indirect or consequential loss;
(b) we are not liable for any decision that you or anyone else makes in reliance on a Tool or a Report; and
(c) our total liability to you for all claims about a Tool, a Report or these Terms, in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to US$100.
15.3 Consumers. If you are a Consumer, clause 15.2 does not apply. We are liable for loss that you suffer as a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not liable for loss that was not foreseeable, or for business losses. A Report is free and general, so please do not treat it as a substitute for your own advice.
15.4 Claims period. If you are a Business Submitter, you must bring any claim within 12 months of the date you knew or should have known of it, to the extent the law allows.
16. Indemnity
16.1 If you are a Business Submitter, you will indemnify Casitel, its Affiliates and their staff against third-party claims, and the reasonable costs that result, to the extent they arise from your breach of clause 3, clause 5 or clause 8.
16.2 We will tell you about any such claim promptly and take reasonable steps to limit the loss.
16.3 This clause does not apply to Consumers. Consumers remain responsible under general law for their own breach.
17. Data protection
17.1 We handle Personal Data under our Privacy Notice. The Privacy Notice sets out what we collect, why, our legal grounds, who receives it, where it goes, how long we keep it, and your rights.
17.2 Ticking the box at Submit is acceptance of this contract. It is not consent to data processing. Where we rely on consent, we ask for it separately. You can refuse it and you can withdraw it.
17.3 Nothing in these Terms removes, waives or limits any right that data protection law gives you and that the law does not allow you to give up.
17.4 Sending your own request is not marketing. We send marketing only as the law allows. Each marketing message lets you opt out.
18. Keeping and removing information
18.1 Personal Data. You may ask us to delete Personal Data. We act on your request as the law requires. We remove it unless a legal exception lets us or requires us to keep it. Examples are legal claims, a legal duty, and a short suppression record so that we do not contact you again.
18.2 Project Information that is not Personal Data. You have no right under these Terms to have this deleted or returned. We may keep and use it under clause 6.
18.3 De-identified and Derived Data. We keep this. We cannot extract your contribution from aggregated data or models.
18.4 Withdrawing a request. You may ask us to stop reviewing a request at any time. We then stop that review.
18.5 Records. We keep a record of your acceptance of these Terms and of the Submission's date and Tool for the period in the Privacy Notice, so that we can show what was agreed.
18.6 Backups. Deleted information may stay in secure backups until the backups expire. We do not restore it to live use except to meet a legal duty.
19. Automated tools and models
19.1 We use automated checks and AI models to read, sort and check Submissions. These may route, flag or score a request.
19.2 A person at Casitel reviews a request before we decide to prepare a Report or to decline it after a review. A Tool may stop early where a fixed rule shows that a request is outside what the Tool covers, such as a minimum site size.
19.3 Model providers act as Service Providers. We do not allow them to train their own models on your Submission.
20. Suspension
We may block a person or company from the Tools if we believe that they have broken these Terms. Clauses that by their nature continue will continue after your request ends. They include clauses 6, 7, 9, 10, 14, 15, 16, 18 and 24.
21. Transfer
We may transfer these Terms to an Affiliate or to a successor to all or part of our business, as long as your rights are not reduced. You may not transfer these Terms without our written agreement.
22. Changes and versions
22.1 Each version of these Terms has a number and a date.
22.2 A new version applies only to Submissions that you send after it takes effect. It does not change the terms of an earlier Submission unless you accept that change.
22.3 We show the current version at Submit and keep past versions at the link in clause 2.5.
22.4 When we make a material change, we show it at Submit before you tick the box.
23. General
23.1 Whole agreement. These Terms, and the Privacy Notice as a notice, are the whole agreement about a Submission, unless a signed agreement says otherwise. Nothing excludes liability for fraud.
23.2 Severance. If a court holds part of these Terms invalid, the rest stays in force. We then apply the invalid part as far as the law allows.
23.3 No waiver. If we delay in enforcing a right, we do not lose it.
23.4 Third parties. Only you and Casitel may enforce these Terms, except that our Affiliates may rely on clauses 6, 15 and 16.
23.5 Events outside our control. We are not liable for delay or failure caused by events beyond our reasonable control.
23.6 Language. These Terms are in English. If we provide a translation and the two differ, the English text applies, unless the law where you live requires otherwise.
23.7 Notices. We may reach you at the email you gave us. Send legal notices to hello@casitel.com and Business Centre, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.
24. Governing law and disputes
24.1 Business Submitters. The laws applicable in the Sharjah Publishing City Free Zone and the United Arab Emirates govern these Terms and any dispute or non-contractual claim about them. The courts of the Emirate of Sharjah have jurisdiction. We may still seek urgent relief in any court to protect confidential information or intellectual property.
24.2 Consumers. The same law applies, but you keep the protection of the mandatory laws of the place where you live. You may bring a claim in the courts of the place where you live.
24.3 Before you start a claim, please write to hello@casitel.com so that we can try to resolve it. This does not stop you from going to a court or a regulator.
25. Regional terms
These sections apply if you live or are established in the place named. If one conflicts with the rest of these Terms, the regional section applies.
25.1 United Kingdom. If you are a Consumer, you have legal rights under the Consumer Rights Act 2015 and these Terms do not affect them. If you are in Northern Ireland or Scotland, you may bring a claim in your local courts. You may complain to the UK data protection regulator.
25.2 European Economic Area and Switzerland. If you are a Consumer, nothing in these Terms removes the protection of the mandatory consumer law of your country. In clause 15.2, our liability for intent and gross negligence, and for breach of a duty essential to the contract, is not limited. You may complain to your local data protection authority.
25.3 United States. Clause 15 does not limit liability for gross negligence or wilful misconduct where state law forbids that. Some states do not allow certain limits. If you live in one, those limits do not apply to you. If you are a California resident and the California Consumer Privacy Act applies to us, the rights in that Act apply and you cannot waive them.
25.4 United Arab Emirates, DIFC and ADGM. Clause 15 does not limit liability for fraud or gross mistake, or any other liability that UAE law, or the law of the free zone that applies, does not allow us to limit. Where the law requires your consent to a use of your Personal Data, or to a transfer, we ask for it separately.
25.5 Saudi Arabia. Where Saudi law requires consent for a use or transfer of your Personal Data, we ask for it separately. You may ask us to destroy Personal Data as that law allows.
25.6 India. You may exercise your rights under the Digital Personal Data Protection Act 2023 once they apply. You may name another person to exercise them for you. You may contact us at hello@casitel.com.
25.7 Brazil. You keep your rights under the LGPD and the Consumer Defence Code. Nothing in these Terms removes them.
25.8 Singapore. You may withdraw consent where we rely on it, and we tell you what follows from that. Information that you give us for business purposes may be business contact information under the PDPA.
25.9 Australia and New Zealand. Our goods and services may come with guarantees under the Australian Consumer Law or New Zealand law that cannot be excluded. These Terms do not exclude them. If you are a small business in Australia, the law on unfair contract terms may also protect you, and clauses 15.2, 15.4 and 16 apply only as far as that law allows.
25.10 Other places. If the law where you live gives you a right that cannot be excluded, these Terms do not exclude it. If that law does not allow a Tool to be offered to you, do not use it.
